Terms of sale

1. Who we are and what these terms cover

These Terms of Sale apply when you buy a module, a Pro add-on, or a license renewal from avdude.com. The seller is David Fleming (“AV Dude,” “we”), based in Nashville, Tennessee.

By completing a purchase, you agree to these terms, our License Terms and our Refund policy. If you are buying for an organization, you confirm you are authorized to accept these terms on its behalf.

Who can buy. Anyone may buy, with one temporary exception: we are not currently selling to consumers (buyers purchasing for personal, non-business use) located in the European Union or the United Kingdom. Businesses in those regions may buy by providing their business name and VAT number at checkout. By buying, you confirm that the location and business details you provide are accurate.

Not covered here: custom development projects. Each one is governed by its own written scope and agreement, signed before work begins. Free plugins downloaded from WordPress.org are governed by the GPL and WordPress.org’s own terms.

2. Products, prices and taxes

What you are buying. A license key that gives one production website access to downloads, updates and support for a module, as described in our License Terms. The software itself is licensed under the GPL.

Prices. Prices are shown on each module’s page in US dollars, along with whether the license is lifetime or annual. The price you pay is the one shown at checkout.

Price changes. We may change prices at any time. Changes never affect a purchase you have already completed. For annual renewals, see Section 4.

Taxes. We collect Tennessee sales tax on purchases by buyers located in Tennessee, at the combined state and local rate for your location. Tax is added at checkout and shown before you pay. We collect tax for other states only where the law requires us to. You are responsible for any other taxes that apply to your purchase where you are.

Mistakes. If a price is clearly listed in error, we may cancel the order and refund you in full before the license key is used.

3. Ordering, payment and delivery

Payment. All payments are processed by PayPal. You can pay with a PayPal balance or with any card PayPal accepts. We never see or store your card details. PayPal’s own terms apply to the payment.

Your order. Your purchase is complete when PayPal confirms the payment. Charges appear on your statement under “AV Dude”.

Delivery. Right after payment, we email your license key and download link to the email address on your PayPal account. Nothing is shipped. If the email doesn’t arrive within an hour, check your spam folder, then contact support.

Keep your key private. Treat your license key like a password. Anyone with it can activate the module on a site under your license.

4. Licenses, renewals, refunds and disputes

Licenses. What your license key covers, including sites, staging copies, transfers, updates and support, is set out in our License Terms.

Annual renewals. Annual licenses are subscriptions. By buying one, you authorize PayPal to charge the renewal price each year on your purchase anniversary until you cancel. Renewals are charged at the module’s current price; if it changes, we email you at least 30 days before your next renewal. Cancel anytime in your PayPal account; your license stays active until the end of the year already paid for.

Refunds. See our Refund policy. When a purchase is refunded, its license key is deactivated and any renewal is cancelled.

Payment disputes. Please contact us before opening a dispute or chargeback; most problems are solved quickly. If a payment is reversed, the related license key is deactivated.

5. Warranty and liability

Modules are provided “as is,” as the GPL states, without warranty of any kind. We work hard to make them reliable and secure, and we fix confirmed bugs in updates while your license is active, but we can’t promise a module will be error-free or suit every site. Keep backups of your site.

Limitation of liability. To the fullest extent the law allows:

  • We are not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost revenue, lost data or business interruption, arising from your purchase or use of the Software, even if we were told such damages were possible.
  • Our total liability for any claim relating to a purchase is limited to the amount you paid us for that license in the 12 months before the claim arose.

Some places do not allow these exclusions or limits, so they may not fully apply to you. Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud.

6. Privacy

We collect only what we need to process your order, deliver your license and support you. See our Privacy policy.

7. Changes to these terms

We may update these terms. The version shown on this page when you buy applies to that purchase. Renewals are governed by the version in effect on the renewal date, and we’ll email you about material changes at least 14 days beforehand.

8. Governing law

These terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law rules. Any dispute arising from these terms or a purchase will be heard in the state or federal courts located in Davidson County, Tennessee, and you agree to the jurisdiction of those courts.
